Procedures for Nontoxic Shot and Shot Coatings

ACTION: Notice of information collection; request for comment.

SUMMARY: In accordance with the Paperwork Reduction Act of 1995, we, 
the U.S. Fish and Wildlife Service (Service), are proposing to renew an 
information collection.

DATES: Interested persons are invited to submit comments on or before 
October 15, 2019.

SUPPLEMENTARY INFORMATION: In accordance with the Paperwork Reduction 
Act of 1995, we provide the general public and other Federal agencies 
with an opportunity to comment on new, proposed, revised, and 
continuing collections of information. This helps us assess the impact 
of our information collection requirements and minimize the public's 
reporting burden. It also helps the public understand our information 
collection requirements and provide the requested data in the desired 
format.
    On May 30, 2019, we published a Federal Register notice soliciting 
comments on this collection of information for 60 days, ending on July 
29, 2019 (84 FR 25068). We received one comment in response to that 
notice but it did not address the information collection requirements. 
No changes were made as a result of their comment.
    We are again soliciting comments on the proposed ICR that is 
described below. We are especially interested in public comment 
addressing the following issues: (1) Is the collection necessary to the 
proper functions of the Service; (2) will this information be processed 
and used in a timely manner; (3) is the estimate of burden accurate; 
(4) how might the Service enhance the quality, utility, and clarity of 
the information to be collected; and (5) how might the Service minimize 
the burden of this collection on the respondents, including through the 
use of information technology.
    Comments that you submit in response to this notice are a matter of 
public record. Before including your address, phone number, email 
address, or other personal identifying information in your comment, you 
should be aware that your entire comment--including your personal 
identifying information--may be publicly available at any time. While 
you can ask us in your comment to withhold your personal identifying 
information from public review, we cannot guarantee that we will be 
able to do so.
    Abstract: The Migratory Bird Treaty Act (MBTA, 16 U.S.C. 703 et 
seq.) prohibits the unauthorized take of migratory birds and authorizes 
the Secretary of the Interior to regulate take of migratory birds in 
the United States. Under this authority, we control the hunting of 
migratory game birds through regulations in 50 CFR part 20. On January 
1, 1991, we banned lead shot for hunting waterfowl and coots in the 
United States.
    This is a non-form collection. Regulations at 50 CFR 20.134 outline 
the application and approval process for new types of nontoxic shot. 
When considering approval of a candidate material as nontoxic, we must 
ensure that it is not hazardous in the environment and that secondary 
exposure (ingestion of spent shot or its components) is not a hazard to 
migratory birds. To make that decision, we require each applicant to 
provide information about the solubility and toxicity of the candidate 
material. Additionally, for law enforcement purposes, a noninvasive 
field detection device must be available to distinguish candidate shot 
from lead shot. This information constitutes the bulk of an application 
for approval of nontoxic shot. The Director uses the data in the 
application to decide whether to approve a material as nontoxic.

application processing fee and $25,000 for solubility testing).

currently valid OMB control number.
