Section 7 Consultation
The Endangered Species Act (ESA) directs all Federal agencies to work to conserve endangered and threatened species and to use their authorities to further the purposes of the Act. Section 7 of the Act, called "Interagency Cooperation," is the mechanism by which Federal agencies ensure the actions they take, including those they fund or authorize, do not jeopardize the existence of any listed species.

One way in which the North Dakota Field Office fulfills the Ecological Services Program Mission is through section 7 consultations under the Endangered Species Act (ESA). Through consultation, we work with partners and action agencies to avoid or reduce impacts to federally listed and candidate species, and their habitats.
Section 7(a)(2) of the ESA requires Federal agencies to consult with the U.S. Fish and Wildlife Service (FWS) to ensure that actions they fund, authorize, permit, or otherwise carry out will not jeopardize the continued existence of any listed species or adversely modify designated critical habitats. Federal agencies are not required to contact the FWS if a proposed action will have no effect on listed species, or if no species are present in the action area. However, Federal agencies must initiate consultation with the FWS if a proposed action may affect one or more listed species. For more information see the FWS's national consultation web page.

Through the use of this tool, you will be able to determine if consultation with the FWS is needed.
