This Memorandum of Understanding (MOU) is entered into by and between the United States Department of Energy (DOE or the Department) and the United States Department of the Interior, Fish and Wildlife Service (FWS)

This MOU meets the requirements under Section 3 ofExecutive Order 13186, (66 FR 3853, January 17, 2001), concerning the responsibilities ofFederal agencies to promote the conservation ofmigratory bird populations. The purpose of this MOU is to strengthen migratory bird conservation through enhanced collaboration between DOE and the FWS, in coordination with state, tribal, and local governments. This MOU does not remove the Parties' legal requirements under the Migratory Bird Treaty Act (MBTA) and other pertinent statutes; thus it does not authorize the take of migratory birds. This MOU identifies specific areas in which cooperation between the Pmiies will substantially contribute to the conse1vation and management ofmigratory birds and their habitats. This MOU replaces the previous 2006 MOU between DOE and the FWS.
