What:

The Service published an Advanced Notice of Proposed Rulemaking in the Federal Register on October 4, 2021, to gather information necessary to codify our interpretation of the MBTA as prohibiting incidental take and propose a system of regulations to authorize the incidental take of migratory birds under prescribed conditions.

To better protect migratory bird populations and provide more certainty for the regulated public, the U.S. Fish and Wildlife Service, Migratory Birds Program seeks to address human-caused mortality by developing incidental take regulations that require implementation of best management practices to avoid and minimize take for many activities that incidentally kill migratory birds. The intent of this action is to develop a mechanism that provides for the conservation of migratory birds while creating more regulatory certainty for proponents of activities that typically result in the incidental take of migratory birds.

To meet these goals, we need to gather information necessary to develop proposed regulations to authorize the incidental take of migratory birds and prepare a draft environmental review pursuant to the National Environmental Policy Act.
