Final Action by DOI

When an AJ has issued a decision (either a dismissal, a summary judgment decision or a decision following a hearing), the DOI must take final action on the complaint by issuing a final order within 40 calendar days of receipt of the AJ's decision. The final order must notify the complainant whether or not the agency will fully implement the decision of the AJ, and shall contain notice of the complainant's right to appeal to EEOC or to file a civil action.
