COMMERCIAL WATERFOWL HUNTING GUIDE SERVICES

AT

WHITE RIVER NATIONAL WILDLIFE REFUGE

 

 

I. INTRODUCTION


White River National Wildlife Refuge is offering commercial guiding opportunities to assist waterfowl hunters in five waterfowl hunt zones of the refuge. All other refuge lands are closed to commercial and sport waterfowl hunting. The North Unit is divided into four hunt zones. Those zones are listed as follows from north to south: Roc Roe Zone, Crooked Lakes Zone, Maddox Bay Zone, and Brown Shanty Zone. The south unit has one commercial zone, the Jacks Bay waterfowl hunt zone. These hunt zones are shown in Appendix 1 of this document. Refuge Special Use Permits will be issued in accordance with 50 Code of Federal Regulations, Subchapter C, Subpart A, Section 29.1, the National Wildlife Refuge Administration Act (16 U. S. C. 668dd-668ee) and The National Wildlife Refuge System Improvement Act of 1997.

 

 

II. DEFINITIONS

 

Guide(s): This term will be used from this point forward in this document. This term means – any person including, but not limited to, an individual, firm, corporation, association, partnership, business, club, or private body, any one and all, as the context requires.

 

Commercial: This term means economic gain, monetary or for other consideration derived from refuge waterfowl hunter(s) for services rendered, including but not limited to guiding, scouting, shuttling, outfitting, providing equipment or assistance not otherwise available to the general public.

 

Service(s); This term includes but is not limited to guiding, outfitting, scouting, providing equipment, shuttling, or any other assistance for which economic gain or other consideration is obtained.

 

Guiding: This term means providing commercial services of any nature or kind to refuge waterfowl hunters.

 

Hunt: This term means to pursue, take, shoot, wound, kill, or attempt to pursue, take, shoot , wound, or kill.

 

Hunter(s): This term means any person who hunts on the refuge.

 

 

 

III. PERMIT OFFERING

 

Seventeen Refuge Special Use Permits to conduct commercial waterfowl guiding will be issued for the 2003/2004 season for the five hunt zones. The north unit is divided into four hunt zones (see appendix 1 - map of hunt zones). Those four zones plus the Jacks Bay waterfowl hunt zone on the south unit make up the five zones available for the seventeen permits. Appendix 1 will be a map of the proposed zones. The following information designates the five zones and the number of permits to be issued per zone.

Guided parties will be limited daily to eight hunters, the guide and one assistant who must all remain together as one hunt party. Only one party may be guided each day. Guides can not sublet any part of their hunt zone and are prohibited from subcontracting hunters with any other refuge guide.

 

Only qualified applicants will be entered into the drawing. Therefore, it is essential that all application forms be completed. Only one application may be submitted by applicants including multi-individual guide services (i.e. firms, corporations, partnerships, clubs, etc.). Multi-individual guide services will be required to designate one person to guide and one person to assist the guide on the refuge, if selected. Individual guides employed by one of these entities may not apply and any selected guide will be required to forfeit his/her permit should they become later employed by one of these entities who is also a permit holder. EXCEPTION; All waterfowl zones will be filled by (17) selected qualified applicants, with unsuccessful qualified applicants being placed in a pool of alternates. These alternates will be referred to as the “A-LIST”. The alternates will be identified by their top priority zone and allowed to compete for vacancies in that zone. During the year, the “A-LIST” will be utilized to replace permitted guides that have had his/her permit revoked or denied, and in the event of flooding that makes more hunting habitat available. This list will also be utilized to fill any zones that are vacant after the initial drawing.

 

(A)      Up to (10) additional permits will be made available on the North Unit in the event of flooding. This includes (3) additional permits each for Brown Shanty and Maddox Bay Zones and (2) additional permits each for the Crooked and Roc Roe Zones. Flooding conditions will be defined as 24.5 feet on the White River at St. Charles, Arkansas, and 25.5 feet at Clarendon, Arkansas simultaneously during the waterfowl hunt season.

 

(B)      If vacant zones still exist after the initial drawing, an additional drawing will be held from the “A-LIST” to choose individuals that would like to fill any unoccupied zones. If there are still vacant zones after the “A-LIST” is given an opportunity to fill unoccupied zones, then the original selected applicants may choose to compete for a second permit. This process will be utilized in the event that all zones are not filled initially and to fill the additional permits available in the event of flooding. NOTICE, THESE ARE THE ONLY TIMES ONE GUIDE SERVICE MAY POSSESS MORE THAN ONE PERMIT. Under these circumstances, a guide that is selected for a second permit may identify a permit holder and assistant for the second permit. All persons identified must meet all standards with-in the application.

 

All prospective applicants are advised to read this policy and application in its entirety. All applicants are responsible for making their own investigations as to the economic feasibility of commercially guiding waterfowl hunters on the refuge.

 

Applicants must complete all Appendix 4 forms (Application Cover Sheet, Form A - Guiding History, Form B - History of Violations, Form C - Safety Record, Equipment, and Training, Form D - Measures to Minimize Impacts/Conflicts on other Refuge Users, Form E – References, and Form F - Application and W-9 form) and submit according to instructions and date provided on front page of the application package (Appendix 4). Completion of these forms is essential to determine that applicants meet experience and other criteria to provide high quality and safe guide services on the refuge. Applicants not meeting the requirements will not be considered.

 

Applicants may apply for up to three of the five available zones. Appendix 4 - Application Package must be used to apply. All applications of qualified guides will be entered into the drawing. Applicants electing to apply for more than one zone must prioritize the zones. The drawing will be held on August 22, 2003 (9:00 am central standard time) at the office of White River National Wildlife Refuge in St. Charles. The drawings for all five zones will be conducted at this time and all interested individuals are encouraged to attend.

 

Permit holders must utilize at least 25% of the possible guided hunter slots. This includes only those hunters that pay for guide services. The maximum number of guided hunters allowed per party under this permit is (8) each day. The permit holder log must reflect that an average of (2) guided hunters per day were commercially guided on Service property. Example: For a 60 day waterfowl season, the minimum number of hunters would be 60 days X 2 hunters/day = 120 hunters total for the season or an average of 2 hunters per day. Failure to meet this standard of use may result in denial of a permit request for the following year. An appeals process will be outlined within all waterfowl guide Special Use Permits for any permit application denial due to this special condition of the permit.

 

 

 

IV. OBJECTIVES

 

Objectives of the guided waterfowl hunting program are twofold:

    To provide high quality waterfowl hunting opportunities for hunters who might not otherwise hunt on the refuge because they lack knowledge or equipment.

    To minimize conflicts between guided and unguided hunters.

 

The National Wildlife Refuge System Improvement Act of 1997 (NWRSIA) established six public uses of refuges which would be allowed when compatible with the established purposes of the refuge and the Service’s mission. These six public uses are: hunting, fishing, wildlife observation, wildlife photography, environmental education and interpretation. All commercial activities including guiding hunters are special uses that must be authorized through a refuge special use permit. These commercial activities can only be authorized when they are compatible with the purposes of the refuge and the mission of the National Wildlife Refuge System. Although hunting is involved on guided hunts, the commercial activities associated with these hunts do not qualify as one of these six authorized public uses (Federal Register / Vol. 65, No. 202 / Wednesday, October 18, 2000 / Rules and Regulations – Issue 13: Priority Uses, Pages 62471 and 62472). This Commercial Waterfowl Guiding Program is being implemented to comply with the legal mandates of NWRSIA including Compatibility.

 

 

V. SPECIAL REQUIREMENTS AND CONSIDERATIONS

 

    Selected applicants and their assistants must possess the appropriate and current Arkansas Game and Fish Commission Guide License. The licenses do not have to be obtained prior to applying for the Refuge Special Use Permits, but the licenses must be presented to the Refuge Project Leader on September 5, 2003 when the Refuge Special Use Permit will be issued.

 

    Selected applicants shall show proof of general liability insurance ($300,000 each occurrence, $500,000 aggregate) with the U. S. Fish and Wildlife Service named as additional insured prior to issuance of the Refuge Special Use Permit. Insurance does not have to be purchased prior to applying, but proof of insurance must be submitted to the Refuge prior to issuance of the Refuge Special Use Permit.

 

    Convicted felons are ineligible. Selected applicants and their assistants may have a maximum of one misdemeanor conviction each for any state, refuge or federal fish or game violation since 1998. Violations occurring after issuance of the special use permit will result in automatic revocation of the permit. Special Use Permit fees will not be reimbursed.

 

    The selected applicants shall be required to complete and furnish to the Refuge Project Leader a report showing the number of clients per day, fees charged and daily waterfowl harvest within one week of the end of the waterfowl hunting season. This report will be certified by the permit holder as complete and accurate and be notarized.

 

    The selected applicants must comply with all terms and conditions of this policy and application document and the resulting Refuge Special Use Permit, Refuge Hunting Permit, Refuge laws and regulations, Arkansas Game and Fish Commission Regulations, and pertinent Arkansas Legislative Acts and resulting regulations/laws.

 

     The hunt area is open on a first come-first serve basis. Applicants should review Appendix 2 – Interference and Harassment Laws. A documented and verified complaint or violation by a guide and/or member(s) of his party concerning interference or harassment of other refuge hunters or other public users will be considered grounds to revoke this permit, and may also subject the guide/party member(s) to a citation. All such complaints will be investigated by a refuge officer.

 

 Selected applicants must provide the refuge with all required information (guide license, insurance policy, permit fee, etc.) by September 5, 2003.

 

    No person, including but not limited to a guide, guide service, outfitter, club, or other organization shall provide assistance, services, or equipment on the refuge to any other person for compensation unless such guide, guide service, outfitter, club, or other organization has obtained a Special Use Permit from the refuge. For the purpose of this regulation, any fees paid or services rendered to a person for lodging, meals, club membership or similar services will be considered compensation.

 

    Hunting, taking, possessing, or attempting to take wildlife with an unauthorized guide, guide service, outfitter, club or organization providing assistance, service, or equipment is prohibited.

 

 

VI. REFUGE SPECIAL USE PERMIT FEE

 

Section 5 RM 17.5 of the Refuge Manual states: Establishing fees. The law provides that. . . . and the granting of privileges may be made upon such terms and conditions as the Secretary shall determine to be in the best interests of the Government . . . . The Secretary, by regulation, has required that rates of charge shall be commensurate with the value of the privilege granted. In establishing fees due regard will be given to the prevailing market prices in the vicinity. These principles shall govern the establishment of contract fees on refuges.

 

Three methods are available to establish fees - Competitive Bids, Informal Bids and Prevailing Rates. The prevailing rate method was selected for this commercial activity. This rate could be established by a market comparison of the lease price for comparable waterfowl habitat by guides in the private sector or by a determination of the prevailing rate clients pay to guides. The latter was selected. Rates for a guided hunt in this area range from $80 to $120 per day with $100 being the prevailing average daily rate charged. Utilizing this amount x eight hunters/day x 60 days/season = potential gross income value of $48,000. The refuge fee will be 3% of the gross income potential plus a $100.00 administrative fee which totals $1540.00. If the duck season is reduced from 60 days to a shorter duration, the annual fee will be reduced proportionately each year. An example of this is shown in the table below including the reduced hunter days at Jacks Bay.

Jacks Bay area figures were calculated using 4/7 th of the total days possible(60). This hunt area is open on every Tuesday, Thursday, Saturday, and Sunday of the state waterfowl season.

All stated permit cost include the $ 100 administration fee.


VII. GENERAL TERMS

 

    The government reserves the right to extend the dates for receiving applications, selection date and to not award any or all Refuge Special Use Permits for Waterfowl Guiding.

 

    The government reserves the right to reject any and all applications containing a history of game and fish/refuge violations, false information, illegible information, partially completed applications or applications of inexperienced applicants. If a Refuge Special Use Permit has been issued under false application, it may be terminated at once.

 

    Any oral statement by any representative of the Government, modifying or changing any conditions of this document is an expression of opinion only and confers no right upon any applicant.

 

    In the event that a contradiction exist between this document or sample permit (Appendix 3) and the conditions in the issued Refuge Special Use Permit, the conditions in the Refuge Special Use Permit will govern.

 

    The government reserves the right to cancel any Refuge Special Use Permit issued for non-compliance with any terms or conditions of this policy and application document, Refuge Special Use Permit, Refuge Hunting Permit, state and federal regulations or other actions undertaken with the intent of doing harm to the refuge and government.

Appendix 2

 

 

Interference and Harassment Laws/Regulations

 

Arkansas State Law 5-71-228. Obstruction of shooting, hunting, fishing, or trapping activities.

 

     (a) It is unlawful for any person to willfully obstruct or impede the participation of any individual in the lawful activity of shooting, hunting, fishing, or trapping in this state. Provided, that nothing in this section shall prohibit a landowner or lessee from exercising his or her lawful right to prohibit hunting, fishing, or trapping on his or her land, or from exercising any other legal right.

     (b)(1) A court of general jurisdiction may enjoin conduct which would be in violation of subsection (a) of this section upon petition by a person affected or who reasonable may be affected by such conduct, upon a showing that such conduct is threatened or that it has occurred on a particular premises in the past and that it is not unreasonable to expect that under similar circumstances it will be repeated.

     (2)(A) A court of general jurisdiction may award damages to any person adversely affected by a violation of subsection (a) of this section which may include an award for punitive damages.

     (B) In addition to other items of special damage, measure of damages may include expenditures of the affected person for license and permit fees, travel, guides, special equipment, and supplies, to the extent that such expenditures were rendered futile by prevention of taking of a wild animal or fish.

     (c) Any person violating the provisions of this section shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500), or imprisonment for not to exceed thirty (30) days, or both, and if such person holds an Arkansas hunting, fishing, or trapping license at the time of conviction, such license shall be revoked.

     (d) This section shall not prevent any wildlife officer or other law enforcement officer from performing his or her duties.

 

50 Code of Federal Regulations, Subchapter C, 27.84; Interference with persons engaged in authorized activities.

 

Disturbing, molesting, or interfering with any employee of the United States or of any local or State government engaged in official business, or with any private person engaged in the pursuit of an authorized activity on any national wildlife refuge is prohibited.

Sample Permit                                                          

The following pages contain information validating a complete sample of a waterfowl guiding Special Use Permit. Information includes a sample permit, special conditions of the permit, commercial waterfowl guide hunt summary, and the commercial waterfowl guide summary.

 

 


 


 

Special Conditions Relating To The Issuance of a Permit For Conducting Commercial Waterfowl On White River National Wildlife Refuge

 

 

     1.              Guiding allowed in commercial guide zone (----------) of the refuge only. All other units and zones are closed to commercial hunting by permittee. Attached map shows all zones and is a part of this permit.

 

     2.              No special privileges are granted to the permittee other than those stated in this Special Use Permit. Interfering with any other individual lawfully participating in any authorized activity on the refuge will be grounds for immediate revocation of this permit and for possible legal prosecution.

 

      3.               The permittee and assistant each must comply with all applicable federal, state and refuge laws and regulations and policy governing hunting, commercial guiding, and use of the refuge. 

     4.              The permittee and assistant each must possess a current Commercial Guide License issued by the Arkansas Game and Fish Commission.

 

     5.              The permittee must verify all clients/hunters have the required and appropriate hunting licenses, signed duck stamps, signed refuge permits and refuge regulations, and any other required documents PRIOR to hunting.

 

     6.              A copy of this permit and a signed copy of the current refuge hunting permit/regulations must be in the possession of the permittee, and assistant while engaged in commercial guiding activities. All members of the hunt party must have a signed copy of the current refuge permit/regulations while hunting.

 

     7.              Guided parties are limited to eight hunters, the permittee and his assistant who must all stay together (total 10) as one hunt party on the refuge. Only one party may be guided per day. Non-paying hunters (Buddies) may hunt with permitted guides, as long as, the total number of hunters in the party does not exceed ten. The permittee must accompany all hunt parties. Any exception to this requirement must be applied for and approved by the refuge manager prior to such event.

 

     8.              The permit holder must maintain accurate, legible daily records indicating the following information; the name and complete hunting license identification number of all hunters in each days hunt party, fees charged, and the number of ducks killed by species for each individual will be logged on forms provided (see attached waterfowl guide hunt summary). This information shall be furnished to a wildlife officer or the refuge manager upon request. The completed forms will be notarized and returned to the refuge manager by the end of one business week form the close of duck season. All names of hunters and license information must be recorded prior to each days hunt.

 

     9.              This Special Use Permit may be canceled or revised at any time by the Refuge Manager in case of emergency(e.g. high fire danger, flooding, unusual resource problems, or violation of permit,etc.) Any violation may be grounds for future permit denial.

 

     10.            The permittee agrees to forever hold harmless the United States, its officers, agents, employees, contractors, and or assigns from any and all damages to property or injuries to persons which may arise or be incidental to the activities associated with this Special Use Permit, above and beyond the required liability insurance policy.

 

     11.            Permittee will acquire the required general liability insurance policy of $ 300,000 each occurrence, $ 500,000 aggregate with the U.S. Fish and Wildlife Service named as additional insured prior to issuance of this Special Use Permit. Permittee will maintain this same policy through the duration of this permit. Any changes in policy will be approved by the Refuge Manager prior to implementation.

 

     12.            All equipment (except boats, motors, and atvs that comply with refuge regulations) must be removed from the refuge daily.                                    

     13.            All boats and other vehicles used in the commercial guide operation must be marked with a guide identification sticker, Boats----on the side of the motor hood, Trucks----on the back glass of the cab, and Atv’s ----on the side of the fuel tank. Stickers will be provided by the Refuge.

 

     14.            Only one set-up of decoys (regardless of number) may be used per guide party.

 

     15.            Revocation of Guide Special Use Permit/Helpers Special Use Permit will result fro violation (by permit holder) of any refuge hunt permit, violation of any state or federal migratory bird regulation, or the permit holder accumulating more than six (6) points on their records for any Arkansas Game and Fish violation after the Special Use Permit has been issued.

 

     16.            Permitted Guides will only be allowed to name assistants during the application process, those guides that do not name an assistant prior to the drawing of permit holders will not be allowed to name an assistant at a later date.

 

     17.            All definitions identified with-in the prospectus will be valid for this permit. (Examples; Guide, Commercial, Service, Guiding, Hunt, and Hunters)

 

     18.            Any oral statement by any representative of the Government, modifying or changing any conditions of this document is an expression of opinion only and confers no right upon any permit holder.

Fully complete all questions below. Applicants must be able to document a minimum of three years waterfowl guiding experience including one year in Arkansas, in order to be eligible to apply and guide on the refuge.

FORM B - History of Violations

 

Since June of 1998 have you, any assistant employed in your guiding operation or client you were guiding at the time been convicted of, forfeited collateral, pled nolo contendere, had your guiding license or privileges suspended, or been administratively penalized for violation of any Federal, State or local fish, game or guiding rules, refuge special use permit terms, regulations and/or laws? If yes, list each incident and give the name of the person, place of occurrence and name/address of the law enforcement agency and/or court involved (and explanation, if you desire). Guides and their assistants may have a maximum of one (6 point) misdemeanor conviction each for any state fish or game violation. In addition guides and assistants may only have one federal fish or game violation since 1998 to be eligible. Individuals convicted of felonies are not eligible. FORM C - Safety Record, Equipment, and Training

 

Provide information on safety equipment to be provided, training and qualifications you and the assistant employed in your operation possess. List all accidents and safety related actions involving your guiding operation or personal hunting experiences that have occurred since June 1998. List all safety related training that you or your assistant have taken (i.e., boat operation, advanced first aid, CPR, ETT, EMT, search and rescue training, etc). List emergency communications equipment and address your plans in the event of mechanical failures, medical or cold weather emergencies and other types of accidents/incidents. Safety equipment required by law (i.e., life jackets, etc) are mandatory.
