Step 3. Will your activity occur during the breeding season?
Your activity is flying helicopters or fixed-wing aircraft near nesting bald eagles during the breeding season (Oct 1- May 15).
Therefore, to avoid disturbing nesting eagles and their young, it is recommended that you: avoid operating aircraft within 1000 feet (305 meters) of the nest, except where eagles have demonstrated tolerance for such activity.

Yes - I can meet these guidelines. I don't think my project will disturb eagles and I do not wish to apply for a permit at this time.
