grey-backed tern 512x219The atoll and surrounding waters out to 50 nautical miles from shore are part of the Pacific Remote Islands Marine National Monument. 

Management authority for the Pacific Remote Islands Marine National Monument, including Wake Atoll, was given to the Secretary of the Interior, in consultation with the Secretary of Commerce. The Presidential Proclamation prohibits commercial fishing within the monument, but gives the Secretary of Commerce, through the National Oceanic and Atmospheric Administration, primary responsibility for managing fishery-related activities. 

In addition, the Secretary of Defense continues to manage the emergent lands of Wake Atoll under an existing agreement between the Secretary of the Interior and the Secretary of the Air Force. Should that agreement be terminated, the lands would become part of the National Wildlife Refuge System. On January 16, 2009, the Secretary of the Interior delegated his management responsibilities for the monument to the Fish and Wildlife Service through Secretary’s Order 3284.
