3.1 Purpose. This chapter describes the requirements to obtain approval for making organization changes (establishment, abolishment, modification, or relocation) within the Service.

3.2 Approval Authority.

A. Headquarters.

(1) Changes in Headquarters down to and including a division or equivalent must be approved by the Assistant Secretary - Policy, Management and Budget. Requests for approval must comply with 3.3 below and 101 DM 3.

(2) Changes in headquarters organizational elements outside of the Washington metropolitan area and other non-regionalized offices that report directly to Headquarters must be approved by the Assistant Secretary - Policy, Management and Budget. Requests for approval must comply with 3.3 below and 101 DM 3.

(3) Other changes in Headquarters at the branch and lower levels must be approved by the supervising Assistant Director. Any organization code changes will be requested pursuant to 020 FW 2.5.

B. Regional Offices.

(1) Changes in the scope or location of Regional Offices must be approved by the Assistant Secretary - Policy, Management and Budget. Requests for approval must comply with 3.3 below and 101 DM 3.

(2) Changes (establishment, abolishment) in Regional Offices down to and including a division or equivalent must be approved by the Director. Requests for approval must comply with 3.3 below.

(3) Changes in Regional Offices at the branch and lower level must be approved by the supervising Regional Director. Any organization code changes will be requested pursuant to 020 FW 2.5.

C. Field Stations, Field Units, and Satellites.

(1) Changes (establishment, closure, relocation) in field stations, field units, or satellites must be approved by the Assistant Secretary for Fish and Wildlife and Parks. Requests for approval must comply with 3.3 below and 101 DM 4.

(2) Changes (major modifications in scope or responsibilities) in field stations must be approved by the Director. Requests for approval must comply with 3.3 below.

(3) Other changes (modifications) in field stations, field units, or satellites must be approved by the supervising Regional Director. Any organization code changes will be requested pursuant to 020 FW 2.5.

3.3 Approval Procedures.

A. For changes requiring the approval of the Director or higher authority, the originating Assistant Director or Regional Director will prepare a justification statement that includes the data elements in Exhibit 1, and submit it to the Deputy Director - Staff (DD-S) Attention: Policy and Directives Management staff (PDM). If necessary, a request for an organization code (See 020 FW 2.5) will also be submitted. PDM will distribute copies of the submission to the other divisions identified in 020 FW 1.5 and to relevant Assistant Directors. Upon receipt of comments, PDM will prepare and submit the formal request through DD-S to the Director for approval or concurrence.

B. In addition, for changes requiring the approval of the:

(1) Director; PDM will assure that the formal submittal package includes any necessary changes to 023 FW (Regional Offices organization).

(2) Assistant Secretary for Fish and Wildlife and Parks; PDM will assure that the formal submittal package conforms to the requirements of 101 DM 4.4.

(3) Assistant Secretary - Policy, Budget and Administration; PDM will assure that the formal submittal package conforms to the requirements of 101 DM 3.4.

3.4 Reprogramming Authority. Organizational changes that require reprogramming authority must be submitted by the Assistant Secretary - Policy, Management and Budget to the Congressional Appropriations Subcommittees for approval. A reprogramming request (see 253 FW) must accompany the formal organizational change request to the Director.

3.5 Scheduling of Announcements or Actions

A. Announcements.

(1) No Congressional or public notification of organizational changes requiring the approval of the Assistant Secretary - Policy, Management and Budget, the Assistant Secretary for Fish and Wildlife and Parks, or the Director will be made without the approval of that person.

(2) For major organizational changes, the Department's Office of Congressional and Legislative Affairs and Office of Public Affairs must be notified and a communications plan may be required (470 DM 1.3A(3)).

B. Actions. No interim organizational changes, personnel assignments, reprogramming of funds, or allocation of resources will be implemented until:

(1) A DM release or a Secretary's Order has been approved for organizational changes requiring the approval of the Assistant Secretary - Policy, Management and Budget.

(2) Preliminary approval has been granted by the Director for those organizational changes that must be approved by the Assistant Secretary for Fish and Wildlife and Parks or the Director.
