Permits
The Migratory Bird Treaty Act (MBTA) (703-712) is the primary legislation in the U.S. established to conserve migratory birds.
Under authorities of the MBTA, no one may take, possess, import, export, transport, sell, purchase, barter, or offer for sale, purchase, or barter, any migratory bird, or the parts, nests, or eggs except when authorized by federal and state migratory bird hunting regulations or under the terms of a valid permit issued pursuant to Federal regulations.
The Northeast Region Division of Migratory Birds issues various permits authorizing otherwise prohibited activities to meet special needs. Since the Bald and Golden Eagle Protection Act (16 USC 668-668c) affords additional protection to all bald and golden eagles, the Service provides a separate category of permits for these eagle species.
