Decision Process for "No Effect" Determinations

 

FEMA: Conditional Letter of Map Revision (CLOMR) Projects - Step 3

The Federal Emergency Management Agency (FEMA) is responsible for demonstrating compliance with section 7 of the Endangered Species Act for all projects proposed within Special Flood Hazard Areas where a Conditional Letter of Map Revision (CLOMR) or CLOMR-F (with Fill) request is made for FEMA’s review.

 

As part of the CLOMR application process, FEMA asks applicants to ensure that Endangered Species Act compliance has been achieved prior to submitting their CLOMR applications to FEMA. 

 

We anticipate that many of the CLOMR projects will not affect federally listed species.  Thus, we developed the following process to assist CLOMR applicants in quickly assessing whether they require further assistance from us in meeting their Endangered Species Act requirements per FEMA instructions.  The following steps (3 – 5) help determine whether a proposed action will have an effect on listed species, and if a “no effect” determination is reached, provide documentation to accompany the FEMA application.
