Under the 1992 section 404(q) Memorandum of Agreement between the Department of the Interior and the Department of the Army, Interior can request higher level review of projects that the Fish and Wildlife Service believes will have significant and unacceptable impacts on an aquatic resource of national importance. The process begin with attempts to resolve the issue at the field office level. If unsuccessful, the issue is raised to the Regional level and, finally, to the Washington level. The final decision on the need to elevate a specific individual permit case or policy issue rests with the Assistant Secretary of the Army for Civil Works.
