Wildlife Management Agreement

This agreement dated _________ between the United States Fish and Wildlife Service (Service) and _____________ (Cooperator(s)) is entered into in order to develop lands for wildlife management purposes. Through this agreement, landowners will permit the Service, or its designees, to undertake certain wildlife development activities.

 

The Cooperator(s) agree(s) to place the following __ acres, designated and described on the attached map, into the Wildlife Management Agreement for the period _____________ to _______ ________.

 

The Wildlife Cooperator agrees to the following terms and conditions:

 

1.      Cooperator agrees to allow the Service to enhance grasslands/oak savannas on the designated acres (see attached map). The number of acres seeded, mix, rate of seeding, or maintenance activities will be mutually agreed upon by the Service, or designated representative, and the cooperator. Cost estimates are provided in attached Appendix A.

 

2.      Authorization to said tract of land by the Service, or designated representative, and its contractors for planting, management, and monitoring purposes is granted.

 

3.      ______ Please initial here if you are willing to allow Service personnel, or designated representatives, to harvest seed from restored areas over the contract period. Harvest methods would be agreed upon by cooperator and the Service and done in an ecologically sensitive manner. Seed will be used on other private lands restoration projects and will not be used for commercial use.

 

The habitat development project shall be considered restoration activities with an estimated cost of _________ (See Appendix A).

 

The consideration for this agreement is the wildlife benefits received by the Cooperator as a result of the habitat restoration. The Service assumes no liability for injury other than injury caused by its own negligence, on the above acreage. The Service assumes no jurisdiction over the above acreage for purposes of controlling trespass, noxious weeds, granting right-of-ways, and other incidents of ownership.

 

This Agreement may be amended at any time by mutual agreement of the parties, and terminated by thirty days written notice by either party. Upon termination, the Service shall be entitled to remove any wildlife management structures placed on the acreage. The service shall have no obligation to restore the land to its original condition upon expiration or termination of this agreement. The Cooperator shall reimburse the Service for the cost of all capital improvements if this agreement is terminated by the Cooperator prior to its expiration date.
